Tennesseans give high marks to Governor Bill Haslam, the Republican-led Legislature, and education reforms passed into law according to a recent poll commissioned by a non-profit organization advocating reforms in public education.
The numbers reveal a public wanting serious education reform and an electorate that believes the Governor and General Assembly are taking the State in the right direction.
A brief overview of the numbers:
- 54% believe the State is headed in the right direction.
- 72% approve of Governor Haslam’s performance.
- 63% of the voters approve of the job of the Legislature.
- 53% believe public schools are off on the wrong track.
- 52% believe schools need “major change.
The poll was taken of 600 likely voters across Tennessee on January 31 and February 1st. The poll has a margin of error of +/- 4%.
In Committee action, the House Judiciary Committee passed two major pieces of legislation. The first bill, a major cornerstone of the Gov’s public safety initiative, specifies that any person convicted of a second conviction of domestic assault must be sentenced to confinement for between 45 days and 11 months and 29 days and to pay a fine of between $350 and $3,500. Additionally, any person convicted of a third or subsequent conviction of domestic assault must be sentenced to confinement for between 120 days and 11 months and 29 days and to pay a fine of between $1,100 and $5,000. The second bill addresses the makeup of the Court of the Judiciary which has been a priority with key members of the legislature.
Testimony was heard in the Senate Commerce and Judiciary committees on the “guns in the workplace” legislation sponsored by Senator Faulk. Both Speakers have indicated that the legislation as written is too broad, and therefore amendatory language is forthcoming on a more reasonable bill, one that looks very similar to what passed last year in Georgia.
The Governor’s major initiative in revamping the state’s civil service system, the TEAM Act, also advanced out of the House State and Local Government committee this week on a 10-5-2 vote. It will be heard next week in the House Government Operations committee. It has already passed out of the Senate State and Local Government Committee.
The House and Senate committees are calling for members to place bills on notice, as the committees will be shutting down within the coming weeks. All things indicate that session will adjourn sine die by the end of April.

Allows a winemaking on premise facility to be issued a license for a business located in a jurisdiction where the establishment of a winery is permitted. Requires an applicant for such licensure to submit a verified, written application to the alcoholic beverage commission. Prohibits a license holder from personally manufacturing wine that is not intended for the personal use of the license holder on the premise of the wine making facility except for wine produced in the process of testing equipment or recipes and producing samples to be distributed. Allows a licensed winemaking on premises facility to serve wine that is produced on the premises of the facility without charge as complimentary samples for tasting at the facility. Requires each applicant for a winemaking on premises facility license to pay the commission a one-time, nonrefundable fee in an amount to be determined by the commission. Lists specific items such facility is allowed to sell on its premises. Requires the commissioner of agriculture to establish reasonable procedures requiring proper sanitary conditions on premises of such facility. Requires any person or corporation transporting any alcoholic beverages or wine within or into TN to bear the burden of proof that the taxes imposed have been paid; however, in the case of wine that is manufactures at a winemaking on premises facility, no such taxes are due. |

Description |
Specifies that an applicant for a license as a limited service restaurant may rebut the presumption regarding the amount of gross sales from prepared food by including a business plan with the application which indicates the gross sales from prepared food will be higher than 20 percent. Specifies that the alcoholic beverage commission shall assess the appropriate license fee based on the projected gross sales found in the business plan. Specifies that an establishment applying for renewal of its license as a limited service restaurant is required to submit a sworn statement indicating the percentage of gross revenue for the previous year derived from food sales and the gross revenue derived from sales of alcoholic beverages. Requires the commission to make adjustments to the license fee based on the gross sales found in the sworn statement. Requires the commission to promulgate regulations based on new statutory requirements within six months of the date the act takes effect. Also requires the commission to submit the rules to the state and local government committees of the house and senate prior to their submission to the attorney general for approval. In regard to tastings held by a retail licensee, clarifies that the tastings may be held without filing notice to the alcoholic beverage commission and that no charge or fee may be assessed by the commission for a retail licensee to offer complimentary samples. Permits the commission to limit the size of each tasting to a specific ounce and the number of samples a customer may taste in any one day. |
